Business terms and conditions
Your use of our services is subject to the following general terms and conditions. Since we tailor our services to your specific needs, we might, after mutual agreement, include specific terms & conditions in any contract.
Booking
We shall make every effort to ensure that you know what we can provide and that what we can provide is within your expectations. You shall make every effort to ensure that we know what you expect and that what you expect can be provided by us. By sending us a request for a quote, you declare that you have read, do understand and accept our terms and conditions.
Payments
After you and we have come to an agreement, we shall invoice you detailing all necessary payment information.
To secure your booking, a 50% deposit needs to be in our account within 3 working days of the invoice date. The balance needs to be in our account upon delivery of the service.
You can pay into our EUR bank account or into our GBP bank account.
Late payments will incur a penalty of 10% and, in addition, a fixed charge of EUR 50 under GBP 1k debt, GBP 100 for debts between GBP 1k and GBP 10k and GBP 500 for debts > GBP 10k.
Our risks
We have extended professional skipper's liability insurance in place. It covers any claims from third parties regarding:
Damage to the yacht operated by us in the event of proven gross negligence; Up to EUR 5m personal injury and damage to property caused by the yacht operated by us; Compensation of the crew among one another onboard the yacht operated by us; Security deposit/bailment in the event of confiscation of the yacht operated by us; Compensation of the owner of the yacht operated by us for loss of charter income arising from culpable significant damage to the yacht.
Our extended professional skipper's liability insurance is always second-ranking to the operated yacht's liability and hull insurance. This means that our insurance always pays out on a secondary basis.
Your Risks & Responsibilities
You agree that you will not hold us liable for any possible personal medical, hospital, accident costs or loss in anyway of any personal belongings or any (other then as defined under 'Cancellation') cancellation costs.
It is your responsibility and therefore you have to ensure that any yacht that you assign us to operate lives up to all appropriate and applicable legal, registration, safety, hull and third party insurance requirements.
The insurance for the operated yacht is always prior-ranking to our professional skipper’s liability insurance. This means that your yacht's hull and liability insurance always pays out on a primary basis.
You agree that you will not hold us liable for: The first three days loss of charter income arising from culpable significant damage to the yacht operated by us; In case of proven gross negligence the first EUR 2,5k or any amount over EUR 550k regarding damage to the yacht operated by us; Any security deposit over EUR 50k if the yacht operated by us is impounded; The first EUR 150 of a claim against the skipper from anyone on board the yacht operated by us.
Changes
If requested by you and only at our discretion we may transfer your booking to an alternative.

Cancellation
If you cancel your booking you will loose any fees you paid us.
In the unlikely event of us cancelling your booking we will refund 100% of the applicable fee you paid us. We shall not in any case be liable for any other refunding of any other expenses.
Complaints
If you have any complaints then you must inform us immediately and unless absolutely impossible, we will deal with problems then and there.
If an issue persist, submit your complaint to us in writing. We will instigate an investigation quickly and take appropriate action if deemed necessary.
General
We do not accept claims and shall not be liable at any time for claims or expenses caused by circumstances beyond our control including but not limited to: sickness, accident, travel delays, weather, strikes, war or civil unrest.
We reserve the right to alter any of our publications without prior notice.
Yachting Experience is a Ben Harmsen business registerd in the UK.
Yachting Experience is currently exempt from collecting VAT.
